Environmental Insurance Expert Witness

Subcommittee

The expert witnesses assembled by the Environmental Risk Resources Association are a unique talent pool with hands on experience on thousands of environmental insurance placements spanning more than twenty years. Members of the ERRA expert witness subcommittee have testified in both state and federal courts.

ERRA has experts in forensic insurance market research and can answer question like: "How much would an environmental insurance policy cost on the ABC company in 1992?"or "What were the underwriting guidelines for underground tank insurance in 1996?"

ERRA experts are also able to reconstruct the availability of various forms of environmental insurance from 1980 to today.

Members of the expert witness subcommittee are also experts in environmental insurance coverage and underwriting intent over the entire history of the environmental insurance market.

Dan R. Anderson
Mr. Anderson is a

Served as an expert witness before state and federal legislative committees.

William M. Blankinship
Mr. Blankinship has more than 20 years of experience in the commercial Property and Casualty Insurance field. He was a co-founder and principal of two brokerage firms, which were acquired by larger firms in 1987 and 1990. Since the mid-1990’s, Mr. Blankinship’s business has emphasized developing insurance-backed financial solutions for balance sheet and earnings issues, credit enhancements, regulatory issues and other areas for which there may not be a traditional insurance market. Business development has been focused on transaction-oriented activities and projects. Successful projects have included balance sheet transfers, captives, finite insurance studies, environmental “wraps” and various types of specialized financial coverages involving real estate, securities and capital markets transactions.

David J. Dybdahl, CPCU, ARM
Mr. Dybdahl is a licensed excess and surplus lines insurance broker and consultant specializing in environmental insurance and risk management. He is internationally recognized for his expertise in the area of environmental risk management. He has served on the United States Environmental Protection Agency’s Contractor Indemnification Technical Review Panel and provided technical information on environmental insurance issues to the United States Department of Defense and Department of Energy. He is the former Chairman of the Environmental Task Force of the National Association of Insurance Brokers. He has successfully placed insurance programs on many of the world’s toughest environmental risks including developing the first environmental insurance policies for Superfund contractors, placing the first wrap up insurance programs on the US Department of Energy’s nuclear weapons facilities at Hanford, Washington and Oak Ridge, Tennessee and insuring the remediation of Chernobyl. His work experience includes risk management consulting for a major manufacturer of asbestos, insurance brokerage, creating the Global Environmental Practice, and serving as the Chief Knowledge Officer of one of the worlds largest insurance brokerage firms, and founding The Environmental Risk Resources Association. Mr. Dybdahl has published numerous articles in journals and textbooks including the chapter on environmental insurance in the CPCU 4, Commercial Liability, Risk Management and Insurance textbook, Business Insurance, National Underwriter, Bests Review, Risk Management magazine, Risk Management Today, The John Liner Review, The Associated General Contractors, Construction Contractors Environmental Risk Management Procedures Manual, Rough Notes, and The Design Professionals Handbook of Business and Law.

Robert Rosenfeld
As director of the Environmental Risk Management practice, Mr. Rosenfeld worked both independently and with a staff of ten professional brokers in developing and deploying environmental and global risk management solutions for external clients. Responsible for business development, marketing, quantitative risk and financial analysis of projects, transactions and portfolios, underwriting, negotiating and drafting insurance contracts, program development and management. Expertise in the integration of financial engineering and quantitative risk techniques for environmental and global risk in large-scale projects, transactions and portfolios. Accomplishments: · Founded one of the first environmental practice groups in the excess and surplus lines field with a focus on consulting as well as brokerage. · Generated over $1 million in revenues from consulting and insurance brokerage services. · Developed and presented state-approved continuing education courses for insurance and legal professionals. Risk management instructor for agency promoting redevelopment of public and privately held properties. Invited speaker on quantitative methods, environmental risk and insurance at trade association annual meetings. · Developed customized financial engineering solutions based on Monte Carlo risk models and the integrated use of insurance, other contracts, engineering controls and structured financing for complex remediation and construction projects.
