However as you will see by the broad array of specialty policies and programs that are available, environmental insurance can be a very complex topic. The effective procurement of environmental insurance requires specialized knowledge in environmental risk management topics and advanced insurance skills. Members of the Environmental Risk Resources Association are available to assist insurance agents and consumers in obtaining insurance coverage. Environmental insurance program can be powerful tools to use in an overall environmental risk management strategy.

SCHAUMBURG, IL, January 17, 2000 -- The Environmental group at Zurich U.S. announced that it has appointed Bonding & Insurance Specialists Agency, Inc. (BISA) as Program Administrator for abatement contracting risks, including lead and asbestos abatement. Centralization of this specialty line enhances consistency of products and service delivery as BISA will now perform much of the underwriting, rating, quotation, policy issuance, and general servicing of this business on behalf of Zurich U.S. BISA, headquartered in Bridgeview, IL, specializes in insurance and surety for the environmental industry.
In addition, the BISA program includes surety bonding as a component of its overall environmental package approach. The complete package can include general liability, environmental liability, professional liability, workers' compensation, automobile, excess/umbrella, as well as surety bonds. GULF IMPROVES POLLUTION CLEANUP PROGRAM
(Posted 8/2/2000; Crittenden Environmental Liability News, Vol. 10, No. 6, June 5, 2000)Gulf improves its Agrichemical Retailers Association (ARA) environmental impairment liability coverage. The seven-year-old program offers claims-made pollution cleanup coverage for sudden and accidental spills of pesticides and fertilizers. The policy includes third-party property damage coverage.
Gulf broadens coverage with the removal of an exclusion clause pertaining to sudden and accidental spills impacting natural resources. The insurer also removes an exclusion addressing air borne incidents. Gulf expands the property cleanup policy by including the cleanup of leaks caused by defective tanks during the application process. The carrier also expands the mileage radius from 50 miles to unlimited cleanup of vehicle upset and overturn chemical spills. Premiums begin at $2,000 for the broader form. Limits go to $1 million per scheduled facility with a $25 million aggregate. Single release limits of $1 million are offered. Defense costs apply within the limits of liability. Insureds can opt for a $10,000 minimum SIR.

E&O for Certified Contractors with the American Indoor Air Quality Council
For those who hold a certification (CIAQP, CIAQT, CIAQM, CMI, CMC and/or CMRS) with the American Indoor Air Quality Council will be pleased to know that professional E&O insurance coverage THAT INCLUDES MOLD can be obtained. This is not "group coverage" hence, individual underwriting requirements will have to be met to obtain coverage.

Massachusetts Brownfields Redevelopment Access to Capital
Acting as the selected insurer for the Massachusetts Brownfield Redevelopment Access to Capital (BRAC) program, AIG Environmental created an exclusive insurance program that simultaneously protects Massachusetts developers from escalating costs or unknown legal liability while protecting Massachusetts lenders against defaults due to expenses from polluted conditions. The program includes specifically modified Pollution Legal Liability Select ® (PLL Select ® ), Cleanup Cost Cap (CCC) and Secured Creditor Impaired Property Policy (Secured Creditor) policies as the primary products used to provide the specific coverage needs of the program. The end result is a program that offers strong incentives for the private financing of contaminated property redevelopment by addressing solutions to a typically lengthy list of serious environmental risk exposures faced by both lenders and developers alike.

Associated Builders and Contractors (ABC)
The nationwide Associated Builders and Contractors, Inc. endorses AIG Environmental's environmental insurance program that was built specifically for the needs of their members. Until recently, many ABC members were unaware of the magnitude of the financial risks that not only threatened environmental contractors, but general contractors as well. With no-cost enhancements, this pre-negotiated package nails down incidents that result in bodily injury, property damage or environmental damage from polluted conditions. The Contractors Pollution Occurrence (CPO) can be customized with Supplemental Environmental Auto Liability to cover accidental hazardous spills during transport. For ABC members, these options help build a strong foundation for their operations and can provide shelter against resulting financial liability that stems from environmental exposure.

National Association of Chemical Distributors (NACD)
American International Companies® (AIG) has the endorsement of The National Association of Chemical Distributors (NACD) for its program of specific environmental and casualty coverage including custom management liability for their members. This program offers association members the Environmental and General Liability Exposures ® (EAGLE ® and EAGLE ® Umbrella) programs that are customized to meet risks of environmental exposures specific to the chemical distribution industry. Additionally, members who comply with the Responsible Distribution ProcessSMcan receive special allowances, enhancements and discounts on EAGLE ® products. Moreover, when the management of privately held mid-sized companies such as chemical distributors are faced with liability threats, the NACD program also offers PrivateEdgeSM which provides broad coverage for employment practice claims and private securities claims.

CHURCH MUTUAL ADDS ENVIRONMENTAL DEFENSE
(Posted 8/2/2000; Crittenden Environmental Liability News, Vol. 10, No. 6, June 5, 2000)House of worship leader Church Mutual improves its Crusader Series A and Crusader Series E multi-peril policies with the addition of a new legal defense policy. The defense of environmental suits is one of a number of legal actions lodged against an insured that is covered by the legal defense policy. Other legal actions covered include defense of suits involving contract disputes, discrimination suits, debt collection, landlord/tenant disputes, title to property, federal agencies, and investment transactions.
Coverage applies to countersuits and counterclaims taken as a defensive measure. The new coverage does not apply to actions initiated by the insured. Series E policyholders receive coverage only on churches and day care centers. The new Legal Defense Coverage covers legal costs of defending lawsuits filed against officials, employees and volunteers working on behalf of a church, school, college, camp, day school, day care center, denominational office or assisted-living facility. The Legal Defense Coverage delivers the costs of defense and judgments for suits that Series A and Series E policy general liability coverage may or may not provide. The minimum premium for Legal Defense Coverage is $20 a year for a policy with $5,000 limits and $42 a year with a maximum limit of $15,000. The coverage carries a $250 deductible per occurrence. All new Series A and Series E policies automatically include the new coverage at the minimum limits. Insureds may increased the coverage at their option. Existing insureds can arrange to add the coverage at the time of renewal.
Meanwhile, the insurer enters New Hampshire on a direct sales basis. New Hampshire becomes Church Mutual's 47th state. Church Mutual is a direct writer in all states except Alabama, Arizona, California, parts of Florida, Idaho, Kentucky, Montana, part of Oregon, Nevada, Tennessee and part of Washington where general agents are employed. The insurer does not operate in Alaska, Hawaii and Maine.

AIG ENVIRONMENTAL PROVIDES TAILORED PROGRAM FOR MIDDLE-MARKET ENVIRONMENTAL CONSULTANTS AND CONTRACTORS
NEW YORK, September 12, 2000 - American International Group, Inc. (AIG) has announced that AIG Environmental, a division of the American International Companies, has introduced a new environmental liability program designed to address the needs of environmental consultants and contractors with annual revenue of less than $2 million.*
AIG Environmental has named Birmingham, Alabama-based Environmental Insurance Services, Inc. (EIS) as Managing General Agent for the program to help further penetrate and develop the middle-market segment of environmental consultants and contractors. EIS markets a wide range of environmental liability coverages on a nationwide basis.
AIG Environmental and EIS will market Professional Packaging (PRO-PAC) and Contractors Pollution Liability (CPL) coverages, underwritten by AIG member companies, to environmental consultants and contractors.
PRO-PAC combines professional, general and contractors pollution liability coverage under one form. The general liability and contractors pollution liability coverages are available on an occurrence or claims-made basis, while the professional liability coverage is available on a claims-made basis. PRO-PAC enables the insured to reduce potential coverage gaps that could occur when purchasing policies from different insurers, while eliminating the need for three premiums for three policies. PRO-PAC is available with limits of liability up to $5 million in-house; however, limits are available as low as $500,000 per occurrence or aggregate. In combination with PRO-PAC, umbrella coverage is available with limits up to $5 million.
CPL coverage enables the insured to report claims at any time during or after the term policy, provided the covered damage occurred during the policy term. The occurrence trigger for CPL provides coverage for third-party bodily injury, property damage or environmental damage resulting from pollution conditions. Coverage can be purchased on a blanket or project specific basis and is available with limits of up to $35 million.

AMERICAN SAFETY PROMOTES PROSTAR

The product is designed specifically for environmental contractors, consultants and service firms. The comprehensive policy includes general liability, professional liability, contractors occurrence pollution liability, asbestos and lead abatement general liability, automobile pollution liability, umbrella liability and work comp coverages.
American Safety offers limits up to $20 million on a blanket basis or individual project. Additional limits are available. The multi-year program includes ISO occurrence GL coverage forms, occurrence or claims-made contractors' pollution liability coverage, and a claims-made professional liability policy. The program targets a broad base of health care and social service related businesses including Physician's Offices, Dentist's Offices, Hospitals, Blood Banks, Dialysis Clinics, Emergency Healthcare Clinics, Laboratories, Ambulatory Health Care Clinics, Long Term Care Facilities, Veterinary Offices, and Funeral Homes.
The policy includes On-Site clean up costs, Third Party Environmental Liability and Legal Defense. The basic program offers limits of $1,000,000 on a claims made basis. Minimum premiums start at $2,500 and with deductible options starting at $2,500.

(Posted 8/2/2000; Crittenden Environmental Liability News, Vol. 10, No. 6, June 5, 2000)U.S. Risk Underwriters adds an optional punitive damage cover of up to 20 percent of an insured's total limit to its E&O and GL coverages for engineers, test labs, environmental consultants and related accounts. The E&O is underwritten either by CNA Re in most states or Lloyd's in select states. The cover includes pollution and asbestos liability endorsements. Full E&O limits are offered for the endorsements.
Home inspectors are one of the classes of business eligible for the E&O coverage and also represent one of the hottest risks seeking E&O and environmental coverages. Home inspectors encounter environmental exposures such as testing for radon, lead or other types of testing. Environmental consultants quoted for E&O and GL cover a broad range, including those working in Phase I, II and III environmental site assessments. GL is available only with professional liability coverage.
Testing labs quoted for E&O and GL include acoustics and vibration; biological; chemical; construction materials testing; electrical; environmental; geotechnical; mechanical; meteorological measurement; thermal; and labs working with nondestructive testing involving nuclear and sonar equipment. U.S. Risk Underwriters offers professional liability limits to $5 million. Premiums for $1 million/$1 million start at $2,250. The minimum premium is $1,500 for $500,000/$500,000 limits and $1,000 for $250,000/$250,000. The GL deductibles begin at $1,000. The professional liability deductible starts at $2,500. Eligible risks include attorneys working as regulatory specialists or in permitting and compliance; biohazard medical waste; biologists; chemists; ecologists working with wetlands and those working in emergency response; agricultural pest control advisers; air pollution monitors; archaeologists; and asbestos consultants. Engineers eligible for the coverage include chemical, civil, corrosion, environmental, geological, hydrological, mechanical, metallurgical, mining and petroleum.

Schinnerer program for land surveyors
Schinnerer worked together with CNA Insurance Companies and the American Congress of Surveying and Mapping (ACSM) to develop an insurance program specifically for land surveyors. The CNA/Schinnerer program protects land surveyors against losses from professional liability claims that arise from negligent errors, omissions or acts. This comprehensive coverage - available in every state - is commended by the ACSM for all of its members. ACSM members also receive a 15 percent premium credit. Answering the specific needs of land surveyors for over 25 years, the CNA/Schinnerer program provides many coverage options and can be tailored to fit individual needs.
The Land Surveyors Program now offers a three-year policy. Firms of all sizes are eligible for the three-year program and must be in good standing no deductible collection problems or bad debts. Firms should have a loss ratio of 80% or less for the past 5 years. The program is available in most states.

Maximum Limits: $15 Million

POLLUTION OPTIONS FOR LANDSCAPE, PESTICIDE RISKS

The programs cover landscape gardening; tree pruning, dusting, spraying, repairing, trimming or fumigating; security and patrol agencies; detective or investigative agencies; alarm installation, servicing or repair/alarm monitoring; fire suppression systems installation, servicing or repair; and fire extinguisher servicing, refilling or testing. The coverage adds protection for BI and PD for pesticide/herbicide operations. All programs offer the E&O.
All programs use ISO coverage in addition to an exclusive company form to cover property, inland marine, GL and errors and omissions. GL limits for all programs range from $100,000/$100,000 to $2 million/$3 million. Cover is on an occurrence basis. E&O cover goes to policy limits. Property and inland marine limits can handle anything. GULF INTRODUCES PESTICIDE APPLICATORS PROGRAM

Gulf covers businesses engaged in incidental fumigation. The program provides up to $1 million/$3 million liability limits which apply on a per job location basis. This means the insured does not need to purchase umbrella coverage. The commercial automobile policy includes chemical spill overturn coverage.
The program offers a commercial package policy with property, GL, crime and inland marine. Black White sells the coverage in Alabama, Arkansas, California, Colorado, Florida, Georgia, Indiana, Iowa, Kansas, Kentucky, Michigan, Missouri, Mississippi, Montana, Nebraska, New Mexico, Oklahoma and Texas. Gulf sells the cover on admitted paper. The program eventually will become available in other states. Producers are required to complete an ACORD and supplemental application with each submission. Safeco Offers Two-Part Pollution Cover For Realtors
(Posted 8/2/2000; Crittenden Environmental Liability News, Vol. 10, No. 6, June 5, 2000)SAFECO boosts the National Association of REALTORS (NAR) errors and omissions program with lower rates and improved coverage. NAR represents about 730,000 real estate professionals nationwide. The NAR-endorsed E&O policy can at an extra premium provide pollution liability coverage. This environmental liability protection is packaged in two endorsements. One endorsement provides full limit coverage for residential and nonowned commercial properties. The carrier also offers a difference-in-value endorsement, including $100,000 for commercial properties.
Geo F. Brown & Sons serves as program administrator for the SAFECO/NAR program. The program administrator accepts submissions from all agents. Most producers can expect to pick up a commission of 7.5 percent, whereas established producers generating sizable books of business may see commissions as high as 15 percent.
SAFECO slashes rates 15 percent in at least 13 states. SAFECO eliminates the percentage requirement pertaining to a REALTOR's ownership of residential property that is on the market. Previously, property ownership could not exceed 25 percent. SAFECO offers optional each claim/aggregate limits of $100,000, $250,000, $500,000, $1 million and $2 million with additional options available. The program offers first-dollar defense, full prior acts coverage, and deductible options of zero, $1,000, $1,500, $2,500, $3,500, $5,000 and $10,000.
An employment practices liability endorsement is available. The endorsement comes at full E&O limits. Premiums for this coverage start at $100 if a firm has two employees. See the Geo. F Brown and Sons page for more details.
SAFECO also sells a businessowners policy for NAR members. The BOP is sold through Geo F. Brown & Sons. A workers' compensation coverage is under development and should become available for NAR members sometime this summer.

ECS FORMS SCRAP RECYCLERS PROGRAM
(Posted 8/2/2000; Crittenden Environmental Liability News, Vol. 10, No. 6, June 5, 2000)ECS assembles an environmental liability policy for members of the Institute of Scrap Recycling Industries (ISRI). The institute represents about 1,500 businesses engaged in the recycling of scrap. This program marks the first time ISRI has endorsed a national pollution liability carrier to sell a comprehensive program to its members.
ECS designs the program exclusively for ISRI members. ECS will write a similar policy for non-ISRI members. The ISRI program consists of third-party loss, first-party loss, $1 million of products pollution liability, nonowned disposal site liability and contingent transportation liability. Non-ISRI businesses can choose only third-party loss and first-party loss. ECS writes the coverage on XL paper. Limits up to $100 million are available. Premiums begin at $5,000, and retention starts at $10,000. XL offers optional extended reporting periods up to 36 months for the claims-made coverage. AIG Environmental To Offer Environmental Insurance Program To United States Chamber Of Commerce Small Business Members
NEW YORK, June 14, 2000 - American International Group, Inc. (AIG) has announced that AIG Environmental®, a Division of the American International Companies, has been named the exclusive endorsed provider of environmental insurance products and services to the United States Chamber of Commerce.
The program, named Chamber EnviroPak, was designed to help Chamber of Commerce members address environmental exposures that can lead to significant financial loss. Chamber EnviroPak also helps small businesses secure capital for expansion by providing coverage for environmental liabilities that can be a barrier to obtaining capital. The program offers a comprehensive environmental insurance program for any type of property owner or operator.
Chamber EnviroPak offers Chamber of Commerce members a number of coverage options. PLL Commercial® (Pollution Legal Liability Commercial) provides coverage for facility, contracting and product exposures in a single policy, allowing for efficient coverage of the environmental risks of most mid-sized facilities. PLL policies can be customized to meet the risk management needs of a variety of businesses, such as drycleaners, manufacturers and commercial and retail operations. The second coverage option, TankGuardSM provides coverage for environmental liability associated with underground or aboveground storage tanks. U.S. Risk Underwriters Improves Test Lab Cover
(Posted 8/2/2000; Crittenden Environmental Liability News, Vol. 10, No. 6, June 5, 2000)U.S. Risk Underwriters adds an optional punitive damage cover of up to 20 percent of an insured's total limit to its E&O and GL coverages for engineers, test labs, environmental consultants and related accounts. The E&O is underwritten either by CNA Re in most states or Lloyd's in select states. The cover includes pollution and asbestos liability endorsements. Full E&O limits are offered for the endorsements.
Home inspectors are one of the classes of business eligible for the E&O coverage and also represent one of the hottest risks seeking E&O and environmental coverages. Home inspectors encounter environmental exposures such as testing for radon, lead or other types of testing. Environmental consultants quoted for E&O and GL cover a broad range, including those working in Phase I, II and III environmental site assessments. GL is available only with professional liability coverage.
Testing labs quoted for E&O and GL include acoustics and vibration; biological; chemical; construction materials testing; electrical; environmental; geotechnical; mechanical; meteorological measurement; thermal; and labs working with nondestructive testing involving nuclear and sonar equipment. U.S. Risk Underwriters offers professional liability limits to $5 million. Premiums for $1 million/$1 million start at $2,250. The minimum premium is $1,500 for $500,000/$500,000 limits and $1,000 for $250,000/$250,000. The GL deductibles begin at $1,000. The professional liability deductible starts at $2,500. Eligible risks include attorneys working as regulatory specialists or in permitting and compliance; biohazard medical waste; biologists; chemists; ecologists working with wetlands and those working in emergency response; agricultural pest control advisers; air pollution monitors; archaeologists; and asbestos consultants. Engineers eligible for the coverage include chemical, civil, corrosion, environmental, geological, hydrological, mechanical, metallurgical, mining and petroleum.

Florida Petroleum Liability Insurance Program Administrators (FPLIPA)
FPLIPA is designed for storage tank owners in the state of Florida, and provides coverage for third-party bodily injury and property damage and corrective action in excess of the state fund resulting from pollution releases from storage tanks. The program meets Florida State requirements and federal underground storage tank financial responsibility requirements. Coverage for aboveground tanks is also offered on the same policy. Minimum premiums start at $250.
